Each of these Packets contains a number of different PDF documents plus a set of instructions.
Litigants MUST complete every single document in the appropriate packet to successfully file for a divorce, legal separation, or annulment in Washoe County.
Divorce and Other Choices – NRS 125

Divorce – Unique Features
- Do not need to prove there is a reason for the divorce.
- Can set alimony.
Annulment – Unique Features
- Must prove to the court there are grounds for an annulment.
- Declares marriage null and void as if the marriage never happened.
- Anyone who was married in Nevada or is a resident can ask for an annulment.
Legal Separation – Unique Features
- Cannot remarry.
- Still are legally married.
- A whole new cas may need to be filed in the future to divorce.
- Do not need to prove there is a reason for the legal seperation.
- Can set spousal support.
Shared Between Divorce and Legal Separation
- One person must be living in Nevada for at least six weeks and intending to stay.
- Divides property and debts.
- Sets custody, visitation, and child support.
Shared Between Divorce and Annulment
- Can remarry.
- Returned to the status of unmarried persons.
Shared Between Divorce, Legal Seperation, and Annulment
- Can return to former name.
- Both people do not need to agree to file.
General Notes
- In Nevada, you do not need to go through legal separation before you can get a divorce.
- Both spouses do not need to agree to start a divorce, legal separation, or annulment. If both people do not agree, one person can file a "complaint". If both people agree on the division of everything they can file a "joint petition".
