COURT ORDERED: Ms. Renner to prepare (2) proposed orders (Estate case/Trust case) at her earliest convenience (to include):
PR25-00564 (Kathleen Laxalt Estate):
• Petition to Set Aside Estate to Non-Testamentary Trust Without Administration is GRANTED, acknowledging there has been no objection made and that all parties reserve their rights to contest the underlying Trust.
• Once Ms. Smeland is in receipt of the $8,000.00 from the Wells Fargo account, she is directed to apply it to cure the default.
• Ms. Smeland is entitled to all records from the Wells Fargo account; Ms. Smeland has authority to obtain information and correspond with Wells Fargo in relation to the loan and the account (including the loan and account #’s).
• Thirty-days (30) days after Notice of Default; if this is not cured, the Court is prepared to enter an order selling the home.
PR25-00147 (Kathleen Laxalt Family Trust):
• Counsel is to work together to coordinate a date/time for Trustee Ms. Smeland to be permitted onto the property.
• Ms. Burris is to provide access to Ms. Smeland of all areas of the home at a reasonable time, for up to four (4) hours, within thirty (30) days; Ms. Burris is free to supervise this.
• Ms. Smeland is permitted to take photographs and videos of all areas of the home.
• Ms. Smeland permitted to open boxes/take photos of the contents of the boxes for the purpose of inventorying potential Trust assets.
• The Storage Company (including unit #) shall permit Trustee Ms. Smeland access to the storage unit(s). Ms. Burris is welcome to be present during this time.
COURT FURTHER ORDERED: In-person Status Hearing scheduled for Tuesday, October 14, 2025, at 2:00 p.m., Courtroom “A”, 75 Court St., Reno
*The Parties are encouraged to conduct discovery. Court will order the parties to attend Settlement Conference if the parties have not reached a resolution at the status hearing.
